Your rights as a consumer - Refunds:
In Australia, consumer laws provide certain rights and protections to individuals who purchase goods and services, including courses and training programs. The specific refund rights for courses are governed by the Australian Consumer Law (ACL), which is part of the Competition and Consumer Act 2010.
The ACL sets out rules that businesses must follow when dealing with consumers, ensuring fair and transparent practices. When it comes to refunds for courses, the following key principles apply:
Consumer Guarantees: Consumer guarantees apply to courses, and they include a set of automatic rights that consumers have when they purchase a product or service. These guarantees include the right to expect that the course will be provided with acceptable quality and fit for the purpose it was intended. If the course does not meet these guarantees, the consumer may be entitled to a remedy, which can include a refund.
Right to a Refund: Consumers have the right to seek a refund if the course they have enrolled in does not meet one or more of the consumer guarantees. For example, if the course does not deliver what was promised, has a major problem, or the services provided are significantly different from what was advertised, the consumer can request a refund
Timeframe for Seeking Refunds: The timeframe within which a consumer can seek a refund for a course depends on the nature of the problem. If the issue with the course is major, such as a significant failure to meet consumer guarantees, the consumer may be entitled to a refund within a reasonable time. For minor issues, the course provider may have the opportunity to provide a repair or offer compensation before a refund is considered.
Proof of Purchase: Consumers are generally required to provide proof of purchase when seeking a refund for a course. This can be in the form of a receipt, invoice, or any other documentation that demonstrates the transaction.
Non-Refundable Fees: While consumers have the right to a refund under certain circumstances, there might be non-refundable fees specified in the course's terms and conditions. These fees should be made clear to consumers before they enroll in the course.
Refund Method: If a refund is agreed upon, the course provider is generally required to refund the consumer using the same method of payment that was originally used for the purchase.
It's important for both course providers and consumers to be aware of their rights and obligations under the Australian Consumer Law. The Pilates Studio Teacher Training Refund Policy
Refund Eligibility:
Participants are eligible for a full refund of the training fees (minus an administration fee of $150) within 14 business days from the course start date.
Partial Refunds:
If a participant withdraws after the course has commenced but within the first 5 business days, they may be eligible for a partial refund of 50% of the training fees.
Non-Refundable Fees:
A non-refundable registration/administration fee of AUD $150 will be deducted from any refund amount.
Refund Requests:
All refund requests must be submitted in writing to thepilatesstudioblackwood@gmail.com.
The refund request should include the participant's full name, contact information, and the reason for the withdrawal.
Refund Processing:
Refunds will be processed within 15 business days of receiving the written refund request.
Refunds will be issued through the same payment method used for the original transaction unless otherwise agreed upon.
Instructor Cancellation:
In the unlikely event that the Pilates mat training is canceled by the training organization, participants will receive a full refund of the training fees paid.
Course Modifications:
The training organization reserves the right to make changes to the course schedule, content, or instructors. If substantial changes are made, participants will be notified, and they may request a refund if the changes impact their ability to attend the course.
No-shows and Absences:
Participants who do not attend the training without prior notice will not be eligible for a refund.
Medical or Emergency Circumstances:
Participants who are unable to complete the course due to medical or emergency circumstances may request a refund, subject to the provision of appropriate documentation.
Transfer or Deferral:
In some cases, participants may have the option to transfer their registration to a future course offering or defer their participation. This will be considered on a case-by-case basis. 14 days notice must be given in this circumstance as per the refund eligibility notes above.
